The provisions of a legislative nature of a deliberation taken on the basis of the authorisation provided for in article LO 4435-6 may only be amended by a law if the law expressly so provides. Similarly, provisions of a regulatory nature adopted on the basis of this authorisation may only be amended by a regulation if the latter expressly so provides.
Under the conditions and subject to the reservations provided for in this chapter, the regional councils of Guadeloupe and Mayotte may be empowered to lay down the rules applicable in the territory of their region in a limited number of matters that may fall within the scope of the law or regulation, with the exception of those listed in the fourth paragraph of article 73 of the Constitution.
The request for empowerment to lay down a rule applicable on the territory of the region shall be adopted by reasoned deliberation of the Regional Council taken by an absolute majority of its members. This deliberation shall mention the matter likely to be the subject of the empowerment provided for in Article LO 4435-9. The requests for authorisation referred to in this chapter may not be subject to the local referendum or consultation of electors provided for in chapter II of the single title of book I of part one. Deliberations made on the basis of the authorisation referred to in this chapter may not be submitted to a local referendum.
A Consultative Council of Amerindian and Bushinenge Populations is hereby established in French Guiana. The Council is composed of representatives of the Amerindian and Bushinenge populations.
The composition, the conditions of appointment or designation of the members of the Consultative Council for Amerindian and Bushinenge Populations, its organisation and its operating rules shall be laid down by decree. The composition of the Consultative Council for Amerindian and Bushinenge Populations shall be laid down by decree.
Members of the Advisory Council for Amerindian and Bushinenge Populations are appointed for a term of six years. Any person appointed to replace a member of the Council serves until the expiry of the term of office of the person he or she replaces. The term of office of members of the Advisory Council is renewable.
Any draft or proposed decision of the Regional Council or the General Council that has an impact on the environment, the quality of life or concerns the cultural activities of the Amerindian and Bushinenge populations may be submitted to the Advisory Council for its prior opinion.
