When, before the start of execution of a transferred operation, costs have been incurred by the commune with a view to carrying out this operation, they may be reimbursed by the urban community under conditions set by amicable agreement.
For the performance of contracts, agreements, procurement contracts or administrative and jurisdictional decisions relating to the operations transferred, the urban community is substituted for the communes. It notifies the interested parties of this substitution, in accordance with the rules applicable to each case, and pursues, where appropriate, the proceedings in progress, in accordance with the procedural rules in force.
In the event that an expropriation procedure has been initiated for the benefit of a commune with a view to carrying out an operation transferred to the urban community, the procedure is continued for the benefit of the latter, which is substituted for the commune in all related acts. The procedure is considered to be initiated, within the meaning of the preceding paragraph, on the date of the prefectoral order…
Works assigned to the public domain, which are completed by the communes after the date of transfer of powers, are, from the date of final acceptance of the works, transferred to the urban community under the conditions provided for by article L. 5215-28. The provisions of article L. 5215-39 are applicable, as regards these works, from the date of transfer of ownership.
The maintenance of roads referred to in article L. 5215-30 includes all work undertaken on existing roads, excluding that relating to the creation of new roads.
Each year, the mayor notifies the chairman of the community council of the programme of maintenance work that the town council decides to have carried out on the roads temporarily retained by the commune. In an emergency, the chairman of the community council will at any time, at the mayor’s request, ensure that work not included in the programme is carried out.
Under no circumstances shall the assistance of the community’s technical services give rise to remuneration on the part of the municipalities concerned.
The maximum allowances voted, pursuant to article L. 5211-12, by the deliberative bodies of the agglomeration communities for the effective performance of the duties of chairman or vice-chairman are determined by applying the following scales to the amount of the monthly salary corresponding to the terminal gross index of the civil service index scale: POPULATION TAUX IN % President Vice-Chairman From 20,000 to 49,999 90 33 From 50,000 to 99,999…
Book Six of Part One of this Code is applicable to metropolitan areas insofar as it is not contrary to this Title.
The budget runs from 1 January to 31 December.
